COVID-19 Waiver Agreement

Assumption of the Risk & Waiver of Liability Relating to Coronavirus/COVID-19 by Invitees and Guests of the AT Center

The novel coronavirus, COVID-19 or the “Virus,” has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and health agencies recommend social distancing, facial masks and have prohibited the congregation of large groups of people. The AT Center (the “Center”) has put in place preventative measures to reduce the spread of COVID-19; however, the Center cannot guarantee that you, your family, or your guests will not become infected with COVID-19. Further, visiting the Center could increase your risk of contracting COVID-19.

Protection of Others.

I agree to comply with the Center’s Rules and any additional rules and procedures issued in connection with the COVID-19 pandemic, including but not limited to those which may require social distancing and the wearing of facemasks, and to require my children to do so as well.

I consent to having my temperature taken as a condition to entering or remaining at the Center.

I acknowledge and agree that the Center maintains the right to deny entry to its facilities or participation in Center activities if the result of the temperature check reveals a potential of exposure to the Virus.

I will not, and will not permit my children to come onto Center property if I or they have any symptoms of the Virus, or if I or they have contracted the Virus and have not fully recovered, or if I or they have knowledge of any exposure to the Virus within the prior 14 days or are for any other reason subject to any recommended self-quarantine or isolation.

I agree to immediately notify the Center if I or my children contract the Virus and specifically authorize the Center to disclose such information to its employees, volunteers, guests/invitees or third parties that I or they may have come into contact with at the Center’s property.

I acknowledge that I shall be required to leave the premises if I do not comply with this Section.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I or any member of my family may be exposed to or infected by COVID-19 by my attendance at or use of the Center or participation in Center programming and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by the Virus due to my attendance at, or use of, the Center or participation in Center programming may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Center employees, volunteers and other invitees/guests. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself and my minor children including, but not limited to, personal injury, disability. and death, as well as illness, damage, loss, claim, liability, or expense of any kind that I may experience or incur in connection with my attendance at or use of the Center or participation in Center programming and my contracting COVID-19 or any symptoms related thereto (“Claims”). I hereby release, covenant not to sue, discharge, and hold harmless the Center, as well as any of its directors, officers, employees, agents, volunteers, guests or invitees from any and all liability, directly or indirectly, under any theory of law (contract, tort, negligence or otherwise) available to me or anyone else for any liabilities, claims, actions, losses, costs and expenses of any kind (including reasonable attorney’s fees) or damages (including direct, indirect, special, incidental, punitive or consequential) resulting from or occasioned by my attendance at or use of the Center or participation in any Center programming and contracting COVID-19 or any symptoms related thereto. I understand and agree that this release includes any Claims based on the actions, omissions or negligence of the Center, its directors, officers, employees, volunteers, agents, guests or invitees, whether a COVID-19 infection or the appearance of any symptoms related thereto occurs before, during, or after my attendance at or use of the Center or my participation in any Center program.
